NSW:Elderly pedestrian in Sydney killed

A pedestrian in his 70s has been killed while crossing the road in western Sydney.

The man was hit by a car on Waterloo Road in Greenacre at about six this evening.

Police say the driver failed to stop but attended Campsie police station a short time later.

His white Ford has been seized for forensic examination as he helps police with their inquiries.

The road was closed for four hours.

SYDNEY, Feb 21 AAP - One of Australia's best-known celebrity doctors says it will be
business as usual for his aged care foundation despite his loss of more than $50 million
to a New Zealand fraudster.

Dr John Knight, better known as Sydney broadcaster and author Dr James Wright, was
persuaded by a former neighbour, Derek Turner, to invest tens of millions of dollars of
his family's money in Turner's companies.

Turner, 56, pleaded guilty in a US federal court last August to three counts of fraud,
mainly of investors in New Zealand and …

A new study's found Australian families are forking out more than 50-dollars each week
in bank fees .. with low-paid workers handing over about 30 bucks towards the bank bottom
line.

News Limited papers report the Australia Institute analysis has found excessive fees
and banks charging higher interest rates than needed are helping drive up their profits.

It also says the fees businesses are being slugged .. are being passed on to consumers.

NSW: Three dead in high-speed multi-vehicle crash

SYDNEY, Aug 28 AAP - Three people have been killed and six injured in a high speed
multi-vehicle crash on the Newell Highway in northern NSW.

The incident comes 12 hours after a horrific crash on the F3 motorway on NSW's Central
Coast in which a young family of three died.

Police said three adults in a Ford Falcon died after their northbound car sideswiped
a ute towing a caravan before crashing into a small 4WD travelling in the opposite direction
near Narrabri at 10am (AEST) on Friday.

Both the ute and 4WD were travelling in the opposite direction to the Ford.

The Newell Highway has been closed in both directions following the crash five kilometres
south of Narrabri.

A fourth adult in the Ford has been seriously injured.

A female in the ute suffered serious injuries while a male occupant suffered relatively
minor injuries.

Their caravan was extensively damaged.

Three people in the 4WD suffered serious injuries and are being treated at the scene,
with seven ambulances at the crash site and three rescue helicopters being deployed.

All the injured will be taken to Narrabri District Hospital, police say.

Investigators from Barwon Local Area Command are at the scene and the highway will
be closed for several hours.

Diversions are in place through Gunnedah and Boggabri.

Police are urging motorists to delay any trips through the area if possible.

Fed: Aussie woman dies while walking Kokoda Track=2

The Victorian woman is the third Australian since 2001 to die walking the track.

The woman, trekking with Niugini Adventures that has an office in Canberra, is believed
have died at Ofi Creek only a day and a half after setting off from Owers Corner, outside
Port Moresby.

Niugini Adventures operators in PNG said they wanted the family's permission before commenting.

A medivac helicopter took her body to Port Moresby.

Former Kokoda Track Authority executive officer Warren Bartlett said there had been
a recent spate of injuries along the track.

"Since Wednesday there has been at least 12 injuries or instances where people needed
a medivac out," he said.

"There's been stomach complaints and knee injuries.

"Not just Australians but PNG porters who either had appendicitis or broke their leg
when slipping on a bridge."

In May last year, Shane Green, 32, from Perth died from a suspected heart attack shortly
after setting out on the gruelling track.

will have access to housing .. under a 71 million dollar program.

The federal and Queensland governments will jointly fund the `A Place to Call Home'
scheme .. to provide 143 new houses over five years.

Federal Housing Minister TANYA PLIBERSEK says the program will return stability to
families in crisis.

Queensland Housing Minister ROBERT SCHWARTEN says families experiencing domestic violence
and other issues that place children at risk will be the priority .. as they put the most
pressure on homeless services.

Federal Assistant Treasurer CHRIS BOWEN says non-bank lenders will not disappear completely
.. and will provide competition for traditional retail banks.

The global credit crunch has hit non-bank lenders hard because of their increased borrowing
costs .. and data shows that retail banks are increasing their market share of the home
lending market.

But Mr BOWEN's told the Ten Network .. its a little dramatic to say there won't be
any non-bank lenders.

He also says any reduction in interest rates by the Reserve Bank must be passed on
by retail banks to their customers.

The RBA last week signalled that it could soon start lowering its official cash rate
.. but major retail banks say they can't guarantee they'll follow suit.

Mr BOWEN says the government's plan to make it easier for people to change banks will
come in in November.

Best Buy has announced several executive changes, effective March 2.

Michael A. Vitelli was promoted to executive vice president, customer operating groups. In his new role, Vitelli will lead Best Buy s PC mobility, home solutions and entertainment operating groups and also will have oversight for enterprise merchandising and the company s private label business. Pacific Sales and Magnolia Audio Video also will report to Vitelli. Vitelli previously was senior vice president and general manager of the home solutions operating group.

Vitelli held several executive management positions with Sony Electronics, before joining Best Buy in 2004. He served as president of Sony s personal audio products company; executive vice president of the business and professional products group; executive vice president of the consumer products group marketing; and executive vice president of the visual products company.

David Morrish was promoted to the newly-created position of executive vice president, connected digital solutions. In this role, Morrish will be responsible for working across Best Buy operating groups and brands to develop a business strategy and model that would allow Best Buy to further profit from new connectivity technologies. Morrish and his team also will work to build integrated solutions that would allow customers to subscribe to certain Best Buy products and services. In addition, Morrish will have oversight of Best Buy for Business and other new growth categories, such as they evolve.

"Dave is adept at fostering relationships with our vendor partners as evidenced by building Best Buy s world-class assortment and current strong market share in consumer laptops," said Dunn. Before coming to Best Buy, Morrish spent 17 years with Sears Canada, where he held positions including senior buyer, general merchandise manager and vice president/general merchandising manager.

Barry Judge was appointed chief marketing officer. As CMO, Judge provides overall vision and leadership to all areas of marketing for the enterprise, including brand management, customer research and development, trend, promotions, advertising, marketing communications as well as internal communications and public affairs.

Judge joined Best Buy as a member of its e-commerce team in November 1999. He played an integral role in the launch of BestBuy.com and helped pioneer the company s multi-channel consumer marketing and direct marketing efforts. In 2006, his role as senior vice president of marketing expanded to include oversight of the company s customer research and development capability in order to facilitate increased ingenuity in service of customers and focus on growth. He also gained responsibility for marketing communications, internal communications, public relations, public affairs and promotions at that time.

Judge began his career at The Direct Marketing Group and held marketing and management positions at Young & Rubicam, Coca Cola USA, The Quaker Oats Company and the Pillsbury Company. He also served as vice president of marketing for Caribou Coffee Company.

David Berg was promoted from senior vice president to executive vice president, international strategy and corporate development. Berg is responsible for the enterprise s mergers and acquisition activities as well as the identification and evaluation of opportunities in new geographic markets. He continues to have overall responsibility for the company s commercial office, including oversight of Best Buy s relationship with Accenture as an information technology and human resources outsourced service provider. In addition, he continues to be responsible for the function at Best Buy responsible for purchasing all of the company s goods not for resale. Prior to his strategy and development role, Berg was senior vice president and chief operating officer of Best Buy International, the business unit of Best Buy responsible for growth outside of North America.

Berg joined Best Buy in 2002 as vice president and associate general counsel. He played crucial roles in the company s sale of its Musicland subsidiary, the development of its strategic relationship with Accenture, and its acquisition of a majority interest in Jiangsu Five Star Appliance. In 2004, Berg was promoted to senior vice president, Strategic Alliances, where he focused on maximizing enterprise-wide strategic relationships with significant external parties. State Agriculture Minister KIM CHANCE says Western Australia is hoping for a midnight
release from the lockdown on horse movements designed to halt the spread of equine flu.

A national standstill was put in place on Saturday after signs of of the disease were
detected in horses in New South Wales .. bringing the racing industry to a halt.

Nineteen horses imported to WA from New South Wales over the past fortnight .. have
been tested for the potentially devastating virus .. and the final test results are expected
today.

Mr CHANCE says he hopes WA horses will be given leave to move from midnight tonight.

A 13-year-old girl is recovering in a Perth Hospital after being mauled by a sea lion
on a West Australian beach.

ELLA MURPHY was savaged by the sea lion on Friday .. as she was being towed on a surfboard
behind a speedboat at Lancelin .. north of Perth.

Boat driver and family friend CHRIS THOMAS say the animal attacked the teenager twice
before he was able to drag ELLA to safety.

The girl's undergone emergency surgery for significant injuries to her jaw .. and almost
had a vital artery severed.

ELLA'S doctors say they're amazed her jaw wasn't broken .. and her father says his
daughter is lucky to have survived the attack.

NSW: Total fire ban as warm weather forecast for much of NSW

A total fireban is in place for much of New South Wales today .. with temperatures
above 30 degrees forecast throughout the state.

A hot day is forecast for the greater Sydney region .. and temperatures are expected
to peak at 37 degrees in the western suburbs and a high of 30 forecast for the CBD.

Temperatures in other New South Wales cities and towns .. including Wagga Wagga ..

Bathurst .. Newcastle and Bega .. should also reach the low thirties .. while a top of
38 degrees is predicted for Dubbo.

The Rural Fire Service has issued a total fire ban for the greater Sydney region ..

Illawarra and Shoalhaven .. the far south coast .. Monaro Alpine and the Southern Ranges.

The ban is also in place for the lower central west plains .. southern slopes .. eastern
.. southern and northern riverina .. as well as the south-western and far western regions
of the state.

The ban comes into effect for 24 hours at midnight.

Meanwhile .. a fire burning in the south of the the state near Tumut broke containment
lines yesterday .. but was not posing an immediate threat to property.

Liberal backbencher MALCOLM TURNBULL says the latest interest rate rise has been over-dramatised.

The Reserve Bank lifted the official rate by one quarter of a percentage point to six
per cent last week .. the third rise since the 2004 election.

Mr TURNBULL says it was a significant decision .. but it was one quarter of one per cent.

And he says petrol prices haven't been a major talking point in his inner Sydney electorate
of Wentworth .. which is one of the smallest in Australia .. with the largest percentage
of public transport commuters.

WASHINGTON (AP) _ The Army said Saturday it will launch a criminal investigation into the April 2004 death of Pat Tillman, the former professional football player who was shot to death by fellow soldiers in Afghanistan in what previous Army reviews had concluded was an accidental shooting. Col. Joseph Curtin, an Army spokesman, said the Defense Department office of inspector general had reviewed the matter at the Army's request and concluded that a criminal probe was warranted.

DOHA, Qatar (AP) _ Iraq can expect more bombings like the one at a Shiite Muslim shrine that set off fighting between Shiites and Sunnis, the chief of the U.S. Central Command said Saturday. Gen. CAIRO, Egypt (AP) _ Al-Qaida's No. 2 leader Ayman al-Zawahri criticized the West for its insult to Islam's prophet, complaining in a video broadcast Sunday on Al-Jazeera that the Prophet Mohammed and Jesus "are not sacred anymore." Referring to the cartoons of the Prophet Muhammad that have been printed in a number of European newspapers, al-Zawahri said: "They did it on purpose and they continue to do it without apologizing, even though no one dares to harm Jews or to challenge Jewish claims about the Holocaust nor even to insult homosexuals."

Fire Traps Worker in W.Va. Power Plant

Six-foot, 100-pound underwater gliders are swimming the oceans of the world and dutifully sending data home on everything from whale calls to the massive waves produced by hurricanes. Several ocean scientists reported on the use of underwater gliders at the biannual ocean sciences meeting this week sponsored by the American Geophysical Union.

Arab envoy dead, Zarqawi group says

The insurgent group Al Qaeda in Iraq said Thursday that it had killed the top diplomat in Egypt's embassy in Iraq, Ihab el-Sharif, five days after gunmen seized him on a street here where he had gone unguarded to buy a newspaper.The group, led by Abu Musab al-Zarqawi, named by Osama bin Laden as Al Qaeda's chief representative in Iraq, said in a posting on an Islamic Web site that the killing of the 51-year-old diplomat was ''the judgment of God against the ambassador of the infidels,'' and described him as representing a ''tyrannical'' government in Cairo that was allied to ''Jews and Christians.'' An accompanying video did not show the purported killing, but featured Sharif saying his career had included a stint as Egypt's deputy ambassador in Israel before relations between Israel and Egypt were downgraded in the wake of the Palestinian uprising against Israeli occupation that began five years ago.''Oh enemy of God, Ihab el-Sharif, this is your punishment in this life,'' the Web site posting said.The killing was announced in a statement posted on a Web site frequently used by Al Qaeda in Iraq. The announcement said Sharif's ''confessions were taped,'' but the 90-second video included nothing that resembled an apology or plea. Instead, Sharif, with a thick white blindfold over his eyes and his hands apparently handcuffed behind his back, was shown offering a brief summary of his diplomatic career, in a subdued but steady voice, but without political comment.Many previous Web site videos that Al Qaeda in Iraq has posted announcing the execution of hostages have included scenes showing the actual killings, and in the absence of such scenes on this occasion there was no immediate certainty that Sharif was dead. But an Internet posting by the group on Wednesday, 24 hours before the announcement of his killing, said that it had handed Sharif over to the ''mujahedeen,'' or holy warriors, to ''face his punishment,'' and referred to ''a sharp sword'' that hung over him, implying that Sharif, like many earlier victims of the Zarqawi group, might have been beheaded.The killing, if confirmed, would be the most serious blow yet in efforts by Islamic militant groups participating in the insurgency in Iraq to intimidate other countries in the Arab world that have been moving toward fuller ties with Baghdad since a transitional government with an electoral mandate took office two months ago.Sharif had been designated by the government of President Hosni Mubarak to become Egypt's ambassador here, a symbolic step of major importance to the new Iraqi government, given Egypt's powerful position in the Arab world, and the fact that the new government in Baghdad is led by religious Shiites, while Egypt is a predominantly Sunni Muslim country that has wide influence in the Sunni Muslim world.After two carloads of insurgents seized Sharif in the western Baghdad district of Jamiya on Sunday, pistol-whipping him as they dragged him away from a news vendor's sidewalk stall, the Zarqawi group warned that other diplomats would face the same fate, a warning it repeated in announcing Sharif's death on Thursday. On Tuesday, the abduction of Sharif was followed by drive-by shootings aimed at killing the ambassadors of Pakistan and Bahrain, two other Muslim nations. Both men survived, the Pakistani without injuries and the Bahraini with a bullet wound to one hand.Pakistan, which has forged a close relationship with the United States since the Sept. 11, 2001, attacks, particularly in the conflict in Afghanistan, immediately withdrew its ambassador to Jordan, saying he would return as soon as security conditions allowed.

SYDNEY, June 1 Asia Pulse - Australians would prefer to go online to access government services but only a minority are doing this, the nation's chief information officer says.

Ann Steward says inconsistent data programs for government websites often make it difficult for people to find the services they needed.

"It is often stored in many formats, often stored across various agencies," she told the CeBIT Australia eGovernment forum in Sydney.

"People at the time, when the programs or the systems were being put in place ... probably didn't give account that (consistency) would be important."

Two in five Australians used the internet for their most recent contact with the government, Ms Steward said.

But four in five would prefer to use the internet to access government services.

"Where we get it right, and services are of value, we know our citizens and business want that as the preferred mode of interaction and that's where we're continuing to focus our attention," she said, adding that online government services were a growth area.

Federal Special Minister of State Gary Gray said Australians wanted internet access to government services to be as easy as online banking and shopping.

"People do expect high quality, on-demand and accessible government services just as they do from banks and the retail sector," he told the forum.

Mr Gray predicted the commonwealth's A$36 billion (US$38.43 billion) national broadband network would make it easier for people in regional areas to access services online without "driving many kilometres to the nearest regional centre".

Don't get your compliance record tangled in the Web.

An informal survey of bank sites finds both good and bad compliance news. How can your bank stay clean?

The Internet is a great "leveler" between large and small banks. It provides a cost-effective delivery system for any bank to find and serve customers. Small banks can easily reach thousands of miles beyond local markets to promote niche products or competitive prices. Large banks can offer sophisticated products and high-convenience services to their high-end custom- ers. Both can use the Web to gather precious data on users of their sites and services.

Furthermore, both can use the Web to gain a foothold in the growing market of young, educated, computer-savvy consumers. Branch networks are still important delivery channels, but it takes an active imagination to envision bank lobbies in the year 2000 filled with come-of-age Generation X-ers standing patiently in line for basic transactions.

My parents still go to the bank. I go rarely. My grown son hasn't set foot in a bank in years. And my younger children, like most everyone's, use the computer to research school papers, "talk" with their friends, and conquer distant galaxies. It is inconceivable that they will not use it, almost exclusively, to do their banking.

Hence the proliferation of Web sites as banks learn to make this new channel work for them and their customers. And with this proliferation comes compliance problems.

What's out there--and what's not

For this column, my colleagues and I sampled the Web sites of a variety of financial services providers.

The good news is that we found no outright "horror stories"--practices that would create high-dollar risk exposure.

The bad news is that we found many violations of basic regulatory requirements. This confirmed our theory, based on our consulting work, that there is a widespread lack of communication between the units developing electronic services and banks' compliance experts.

For some reason, when the prefix "e" gets attached to a new product or service (as with "e-commerce"), even banks with top-notch compliance functions somehow forget everything they know about regulations.

We also found a wide spectrum of approaches to voluntary disclosure--efforts to help customers understand Internet banking and make good decisions for themselves.

Those at the better end of the scale are providing customers with information that goes beyond current regulatory mandates. Other banks are meeting only the lower standard of complying with today's rules, which, of course, were not designed with the Internet in mind. Such banks, as a result, are producing sites that arguably are confusing or even misleading to the public. Over the last three decades, banks have learned through bitter experience that customers who feel confused and misled gain the ear of politicians who feel the need for new laws, regulators who feel the need to write new rules, and courts that reinterpret laws and regulations to find new consumer remedies. Today's electronic delivery systems are out in front of the regulatory solid ground-a situation loaded with risk and calling for voluntary efforts to keep risks to a minimum.

Here is a round-up, then, of good and bad practices.

1. Advertising. Every bank Web site we have seen is an advertisement, Therefore, it is covered by the advertising rules that would apply if the same material appeared in a newspaper or other medium.

This means that Web sites for credit products must comply with truth-in lending rules, including assuring that triggering terms are accompanied by required disclosures. [Truth-in-lending disclosures were typically not shown on "shopper" Web sites (ones that have the rates of several banks), where the site is not owned and operated by the bank. This type of "advertising" could signal a need for monitoring those sites in which a bank "participates" with other banks through a third party, a point discussed later.]

Similarly, sites advertising home mortgage credit must provide the Equal Housing Lender logotype and legend. Sites promoting deposit products must provide required truth-in-savings information, including Annual Percentage Yields where applicable. Bank sites promoting non-deposit investment products must give the mandated disclaimers about lack of federal deposit insurance coverage. Home equity loan advertising should include the "consult your tax advisor" disclaimer in addition to other advertising requirements.

We looked at numerous sites that were missing some of these required advertising disclosures. Interestingly, we also found that many sites did not give customers enough information to trigger the advertising requirements, especially on rates. This may reflect bank wariness that rate information is often a trip-wire for regulatory mandates, However, surveys show that consumers like to use online comparison shopping to search for rates, so banks with competitive prices may be well advised to include them in the Web site, and make sure the necessary compliance steps are followed in the process.

2. Problems with disclosures and site design. A common pitfall we noted was that disclosures did not always dovetail with the way the consumer actually uses the site, especially on non-deposit products. A number of sites, including some at large banks, had the required disclosures that investment products were not FDIC insured; however, these sites permitted customers to search the site in ways that severed this disclosure from individual product descriptions. We often found ourselves looking at a computer screen on a non-insured product, with no insurance disclaimer in sight. Depending on the specifics of the situation, this might not be illegal, but in many cases it was confusing at best, and could be construed as misleading.

A good model in this area is one large bank's site. Its mutual funds page has the heading, "Entering XYZ Funds," and continues, "You are leaving the XYZ Bank website and entering the XYZ Funds website....Mutual funds are not FDIC insured and carry no bank guarantees." Other cautions are conspicuously provided and finally a large bold heading says "NOT FDIC INSURED. MAY LOSE VALUE, NO BANK GUARANTEE."

It would be difficult for a consumer to miss the warning here, in contrast to a number of other sites we checked.

3. Privacy notices. Many, although not all, of the sites we visited had voluntary privacy notices, often following guidelines from ABA and others.

There was huge variation in these privacy disclosures. Among 11 large banks we studied, we found highly informative and helpful disclosures at five: Citibank, NationsBank, Wells Fargo, Chase, and Bank of America. We found two with notices we considered inadequate. And we found three large hanks with no privacy notices, at all.

The Citi statement is a good model. It is over a page in length and detailed in describing the bank's policies. The disclosure explains the bank's commitment to keeping customer information confidential; the fact that it shares information with reputable companies; the fact that the bank does not share data with outside parties except in specified circumstances; the fact that it holds employees accountable for meeting privacy standards; and that it has policies on maintaining information security and investigating complaints. Citi promises not to give information to third parties without the customer's written consent.

Wells Fargo's statement covers essentially the same issues, and also offers an opt-out opportunity on marketing. Customers who do not want the bank to use their personal information to target-market them can call a toll-free telephone number to block such promotions. Also, Wells customers are given an explicit opportunity to check the accuracy of the data the bank has on them by calling a toll-free phone number.

NationsBank shows customers how to contact the Direct Marketing Association to be put on its "no-contact" lists.

4. Privacy and data security. A majority of the sites we visited did not allow the customer actually to apply for a loan or open an account on-line, although the industry appears to be moving rapidly toward that. Of those that did permit on-line applications and transactions, some, including one site at a large bank, were not "secure." This means sensitive information, including Social Security numbers, could he intercepted. It seems wider use of non-secure sites will escalate demands for more privacy protections, which will rend to impede growth of this delivery channel.

5. Hard-sell. Another issue relating to on-line loan applications is not about compliance, per se, but could lead to complaints. On a Web site for a large, non-bank lender, we clicked on, "Show Me Your Rates," and got the "Home Equity Loan Rate Shopper Page." This page invited us to fill out some information, "....to help identify the Home Equity Line of Credit rates that are most likely to apply to you" (an interesting statement in itself). After completing this information, we clicked on a bar and suddenly had a screen saying, "In order to process your loan application....

There had been no previous mention of making an application. For customers who are simply rate shopping, this leap to application processing is jarring. If the customer aborts the process, but the lender retains and uses the data, one can imagine charges of consumer abuse.

6. Related parties. We also visited the sites of on-line services such as Yahoo Finance/Bank Rate Monitor and Quicken that give comparative information on rates. Banks should pay attention to privacy and fairness practices at such general sites-especially those they are formally affiliated with. Again, it is not hard to imagine legal liability and/or brand name risk arising in connection with third-party web practices.

7. Other issues. Among the possible issues that may emerge are:

* Pricing. On-line banking user fees could become controversial, like ATM fees.

* Access. Fair Housing Act regulations require home lenders to depict diverse customer types in ads. Many Internet sites portray mainly nonminorities.

Many of the risks cannot be eliminated-the light-speed pace of change will lead to consumer problems that will translate into legislation, litigation, regulation, and reputation damage.

Nevertheless, risks can be minimized if banks treat electronic banking as they treat traditional functions:

* Have everything reviewed by legal and compliance staffs.

* Have compliance people at the table during product and system design. Pay close attention when they frown and say, "well, that's not technically in violation of the rule but ..."

* Build a strong ethical mindset into these new-frontier products. Remember, many of the best retail technology people in banks, as everywhere, grew up in the "anything-goes" ethic that permeated the start-up years of the Internet. Banks should think about how much that environment contrasts with the total-protection mindset that permeates banking consumer regulation. Electronic banking teams must include both types, and need to be sensitive to the fact that what is legal today may be controversial, and very possibly illegal, tomorrow.

A checklist for Web site compliance

* Are FDIC-insurance disclosures made properly and do they appear in the right places? The speed and ease with which a visitor to your bank's Web site can move from the page that offers deposit products to another page that discusses mutual funds-or even to a linked Web site operated by a brokerage affiliate-makes compliance particularly challenging.

* Are all advertising requirements met? A Web page is an "advertisement." All advertising requirements-including the Truth in Lending, Truth in Savings, and the Fair Housing Acts-apply.

* Is there a privacy disclosure? Although a privacy policy is not legally required, developing and implementing one is not only good risk management but will enhance customer acceptance of on-line banking.

* Are affiliated Web sites in compliance? In addition to reviewing your bank's own Web site, be sure to consider the bank's participation in Web sites operated by third parties. On-line shopping services for auto or mortgage loans should be reviewed for compliance.

* Is customer information secure? Protect the security of personal information provided by consumers who visit the bank's Web site. Use appropriate encryption to protect the confidentiality of sensitive information collected via an on-line application.

A CHEAP SHOT FROM MCCAIN.(OPINION)(Editorial)

The proper, respectful and appropriate description for a foe in a debate between two senators is "the senator" or -- if there is a desire to get flowery -- "my distinguished colleague."

But Arizona Sen. John McCain, who after a quarter century on Capitol Hill surely knows the political etiquette, could not bring himself to refer to Illinois Sen. Barack Obama as he would any other colleague.

Discussing a 2005 Senate vote, McCain said, "There was an energy bill on the floor of the Senate loaded down with goodies, billions for the oil companies, and it was sponsored by Bush and Cheney. You know who voted for it? You might never know. That one," he said, motioning toward Obama. "You know who voted against it? Me."

That one?

If Obama had referred to McCain as "that one," he would have been attacked for showing disrespect or ridiculed for being so new to the Senate that he did not understand the basic behaviors of the chamber.

Either way, it would have been a devastating moment.

And it should be for McCain as well.

Understand what the Republican nominee was doing. He did not slip up.

The McCain campaign and its media acolytes have for weeks been spinning the notion that Obama is running as some sort of messianic character who sees himself in something akin to biblical terms.

In Internet advertisements, campaign spin and talk show commentary, Obama is mocked as "the one."

A McCain Web commercial earlier this year compared Obama with Christ. That ad opened with the announcer declaring, "It shall be known that in 2008 the world will be blessed. They will call him 'The One.'" The ad proceeds to ridicule Obama's high-minded rhetoric before closing with the narrator telling Americans: "Barack Obama may be 'The One.' But is he ready to lead?"

That commercial has long been seen as one of the more amateurish cheap shots from a campaign characterized all too frequently by amateurish cheap shots.

Now McCain has brought the cheapest of the cheap shots to the debate stage.

It was, for a senior senator who has embarrassed himself too many times during this long campaign, a uniquely embarrassing moment.

Feisty T'Wolves beat Lakers, square series at 1-1.

MINNEAPOLIS _ Remember when everyone was celebrating the greatness of the Los Angeles Lakers? Yes, that was Saturday.

They weren't Sunday as the Minnesota Timberwolves dominated them in an 89-71 victory that evened the Western Conference finals at 1-1 and equaled the Lakers' franchise low for scoring in a playoff game. Game 3 is Tuesday in Los Angeles.

"All we've done now is make it a series," Minnesota coach Flip Saunders said.

It may be a series, but it doesn't look like it will be fun. The teams combined for three fourth-quarter double technical fouls on pushing-and-shoving incidents and Karl Malone was ejected for a flagrant foul, all with the Lakers trailing by close to 20 points.

"It's just the beginning," Saunders said. "Teams play each other twice in three days, they start not liking one another."

Sore losers? Guys were sore, that's for sure.

Including Shaquille O'Neal, who had 14 points and reverted to his poor free-throw shooting with just 6 of 14 at the line. Kobe Bryant had 27 points as the only other Laker in double figures. For Minnesota, Kevin Garnett had 24 points and Darrick Martin came off the bench for the injured Sam Cassell and had 15 points and six assists.

"We had to find a way to play harder than L.A.," Saunders said.

That the Timberwolves did, pushing aggressively on the perimeter to deny the Lakers' easy entry passes to O'Neal and setting punishing back picks that stood up Lakers defenders.

"They beat us to the punch," Lakers coach Phil Jackson noted in what could become a warning for Game 3. "They came out swinging and got us on the ropes with their aggressiveness. I don't think we expected them to come out with as much bravado. They were setting some back picks and knocking down guys. We got tired of that stuff."

Now the question is whether the Lakers will be teetering.

As for Cassell that was a heck of a 43 seconds.

"I thanked Sam for giving us a great 45 seconds," Saunders joked.

It was the time Cassell played to open the game before returning to the locker room for treatment on his hip and back problems, evoking memories of Willis Reed's inspirational seventh game in the 1970 Finals.

The first time Gary Payton got the ball against a hobbling Cassell, Payton accelerated and Cassell hugged him from behind. Saunders immediately signaled for little-used reserve Martin.

But it was a fortuitous second quick foul against Trenton Hassell that ignited the Timberwolves.

It forced Saunders to bring in Wally Szczerbiak, whose quick shooting burst fueled a flat Timberwolves offense to a 32-24 lead after one quarter.

Happenstance, like Cassell's foul trouble, worked in Minnesota's favor. But the Timberwolves also created their own good fortune with effort. It didn't help the Lakers when Malone drew his third foul running down Fred Hoiberg early in the second quarter. That led to an ineffective parade of substitutes, like Luke Walton, Slava Medvedenko and Brian Cook. With all offensively challenged, Garnett was able to sink in and help on O'Neal.

But the T'wolves also were smarter and more careful. They had just three first-half turnovers and outhustled the Lakers, leading at halftime in blocks and steals and with 15 assists on 18 field goals. Perhaps the close of the first half summed up the 14-point lead as Martin picked up a loose-ball offensive rebound the Lakers stared at and lofted it in for the 51-37 margin as the buzzer sounded.

The Lakers began to gnaw away at the lead late in the third quarter as they forced the Timberwolves into long jump shots that went awry.
